TEL AVIV, Israel

- El Al, Air France, Delta Air Lines and other carriers have petitioned Israel's High Court of Justice (Bagatz) to exempt them from the Aviation Services Law, known as the Tibi Law, for flight cancellations during Israel's war with Iran, known as Operation Shagat HaAri ("Roaring Lion").
- The petition, filed by International Air Transport Association (IATA), Air France, KLM, El Al, Delta Air Lines, Etihad Airways, Aegean Airlines, Bulgaria Air, Netivim Tours and Derech Tzadikim Tours, also seeks future exemption in war-related airspace closures.
- Petitioners argue the 40-day airspace closure in February was unprecedented and left no option to operate flights or offer alternatives.
- The law is similar to Regulation (EC) No 261/2004 in the European Union, which determines the compensation that passengers are entitled to in the event of flight denial, flight cancellation, or delayed departure.
- The Tibi Law's Section 9a, added in 2025, also allows ministerial relief in special circumstances but was not invoked, prompting compensation claims.
- Carriers request court ruling that the Tibi Law does not apply when authorities close airspace for an indefinite period due to war.
